I agree with checkmate. Without customers you have no reason to worry about forming real company. Spend your time on all of the social media sites offering to test your products.

Fyi, Walmart does have a" Local Vendor" program for small start up companies. The problem with that is if your product sales are really good then your limited for 6 months to about 10 stores.
