Hi Sarah, it does not have to be through the same place. It might make it easier to do it through the same place though unless you had a bad experience the first time around.

I think it's a lost cause. I would give her negative reviews online, let it be, and just focus on your day-to-day business. Just my opinion.
Tell him to just form an LLC. It will be taxed the same but it can be helpful to shield him personally from legal liability.

If you're going to pay yourself a regular W-2 salary, set up as an S corp. If you're just going to pay distributions from profits, choose an LLC.
You're not going to be able to distance yourself...

The IRS is more likely to question expenses if you are using an LLC for all sorts of purposes rather than a narrow definable business. Some consulting here, some real estate developing there etc...
